Notice of Advice update: review closed

23rd September 2026

Following our education project focused on disability advocacy services funded by the Victorian Disability Advocacy Program, we have closed out the three Notices of Advice issued to regulated disability advocacy service providers in February 2026.

The notices related to the disability advocacy services who are also registered NDIS service providers. They looked at potential conflict of interest. A complaint about an advocacy service who is also providing an NDIS service at the same time may give rise to an actual or perceived conflict of interest. It may also make complex complaints more complex.

The three providers engaged closely with the DSC throughout the process. They reviewed records and made major improvements to their conflict of interest management, intake processes, and staff guidance.

We encourage all providers to be transparent about any potential conflict of interest, provide a simple documented conflict of interest management statement, and ensure their intake processes and staff guidance are consistent with that approach.

During the process, we also liaised with the NDIS Quality and Safeguards Commission (NDIS Commission). We encouraged providers to continue to seek their own advice on the NDIS Commission’s requirements in relation to the provision of independent advocacy in line with the NDIS Service Provision vs Independent Advocacy – what’s the difference? guidance material.
